This Acceptable Use Policy (the “AUP”) governs the use of the itogai Subscription Service, the Marketing Website at itogai.app, the Platform at platform.itogai.app, and any related services (collectively, the “Services”). It supplements, and is part of, the Customer Terms of Service between Itogai LLC, a Florida limited liability company (“itogai”), and the Customer (as defined in the Customer Terms of Service).
By accessing or using the Services, the Customer and each User agree to comply with this AUP. itogai may update this AUP from time to time as described in the Customer Terms of Service. Continued use of the Services after a material change constitutes acceptance.
1. Purpose
The Services exist to help legitimate professionals understand, organize, and act on their professional networks through the TrustGraph™ scoring algorithm, TrustCircles™ network organization, TrustReach™ warm-network action layer, and Akai™, itogai’s relationship-intelligence co-pilot. itogai is built on a foundation of trust and reciprocity, and on an explicit human-in-the-loop design in which the User reviews and clicks send on every outbound message. Conduct that abuses, weaponizes, or undermines that foundation, against itogai, against other Users, or against any third party whose data flows through the Services, is prohibited and grounds for immediate suspension or termination.
2. Prohibited Conduct
The Customer and each User shall not, and shall not permit any third party acting on the Customer’s behalf to, use the Services to do any of the following.
2.1 Illegal or Harmful Activity
- Engage in any activity that violates applicable law, including any anti-spam, anti-fraud, export-control, sanctions, anti-bribery, data-protection, telemarketing, or consumer-protection law in any jurisdiction in which the Customer, the User, or the recipient is located.
- Engage in or facilitate the harassment, stalking, doxxing, intimidation, or threatening of any individual.
- Promote, organize, or incite violence, terrorism, hate speech, discrimination, or self-harm.
- Engage in human trafficking, child exploitation, or any activity that endangers minors. itogai has zero tolerance for content that sexually exploits or endangers children. Any account involved in such conduct will be terminated immediately and reported to the National Center for Missing & Exploited Children (NCMEC) and to applicable law-enforcement authorities.
2.2 Spam, Abuse, and Unsolicited Communications
- Use TrustReach™ or any other warm-network action feature to send unsolicited bulk commercial communications (spam), to send messages to recipients who have opted out, or to send communications that violate the CAN-SPAM Act, CASL, the GDPR (including ePrivacy Directive consent rules), the LGPD, or any equivalent law.
- Send communications that misrepresent the sender’s identity, that use deceptive subject lines, or that disguise commercial messages as personal correspondence.
- Use the Services to circumvent any third-party platform’s anti-spam, anti-abuse, or rate-limiting controls (for example, sending volumes through Gmail, Outlook, or LinkedIn that violate that platform’s terms of service or that trigger that platform’s abuse heuristics).
- Use the Services to engage in any pattern of cold outreach that is manifestly inconsistent with itogai’s purpose of warm, network-based relationship building.
- Use the Services to operate sequences, cadences, drip campaigns, auto-replies, auto-follow-ups, auto-DMs, auto-emails, or any form of automated multi-step messaging in which a message goes out without the sending User reviewing and clicking send on that specific message. The Services are designed for one-decision, one-send communication. The broadcast feature is the only multi-recipient send pattern that the Services support, and it requires the User to compose once and click send once to an explicit recipient set drawn from the User’s warm network.
- Operate any third-party automation tool, browser extension, scripted agent, or scheduler that simulates a User click for the purpose of sending or scheduling messages through the Services on the User’s behalf.
- Use the Services to blast messages to a list of cold prospects with whom the User does not have an existing warm relationship. The broadcast feature is for warm networks, not for cold outbound, and any attempt to blur that line is a violation of this AUP.
- Brand, label, or describe any User-facing workflow built on or alongside the Services as an “outreach sequence,” “outreach engine,” “outreach automation,” or any other category name that implies the Services automate outbound messaging. The Services do not.
2.3 Privacy Violations
- Submit Personal Data to the Services about any individual without a lawful basis under applicable data-protection law to do so.
- Use the Services to scrape, harvest, or mass-collect Personal Data from any third party in violation of that party’s terms of service or applicable law.
- Use the Services to surveil, profile, track, or build dossiers on individuals for purposes that those individuals would not reasonably expect, including for purposes of intimate-partner surveillance, employment surveillance not disclosed to the affected workers, or political-opposition tracking.
- Submit any Sensitive Personal Information to the Services beyond what is expressly authorized in the Documentation, including, without limitation, protected health information, payment-card data, social-security or government identifiers, biometric data, precise geolocation, or information about minors under sixteen (16).
2.4 Security and Integrity
- Attempt to gain unauthorized access to the Services, to itogai’s infrastructure, to other Customers’ Accounts, or to any Data Source belonging to a third party.
- Probe, scan, or test the vulnerability of the Services or any related system or network without itogai’s prior written authorization through a coordinated security disclosure to legal@itogai.com.
- Interfere with the proper functioning of the Services, including by transmitting malicious code, viruses, worms, or other destructive software; by conducting denial-of-service or distributed-denial-of-service attacks; or by deliberately overwhelming rate limits, queues, or capacity constraints.
- Reverse engineer, decompile, or attempt to derive the source code, models, weights, or algorithms underlying the Services, except to the extent expressly permitted by applicable law.
- Use any automated system (including bots, scrapers, or unauthorized API clients) to access the Services in a manner that exceeds reasonable human use or that violates the Services’ technical or contractual restrictions.
2.5 Intellectual-Property Misuse
- Upload, post, or transmit any content that infringes any third party’s intellectual-property rights, including copyrights, trademarks, trade secrets, or patents.
- Use the itogai, Trustbound™, TrustGraph™, TrustCircles™, TrustReach™, or Akai™ marks, or the itogai logo, in any manner that suggests endorsement, partnership, or affiliation that does not exist, or in any manner inconsistent with itogai’s published trademark guidelines.
2.6 Misuse of AI and Algorithmic Outputs
- Represent any output of the Services, including TrustGraph™ scores, TrustCircles™ assignments, TrustReach™ recommendations, or Akai™ drafts and suggestions, as a deterministic, audited, or guaranteed assessment of any individual or relationship. All such outputs are probabilistic and are intended to support, not replace, the User’s own judgment.
- Use the Services to produce content for the purpose of deceiving, defrauding, or impersonating any individual or organization.
- Use the Services as the sole basis for a decision that has a legal or similarly significant effect on any individual (for example, employment, credit, or housing decisions). Any such use is contrary to the Services’ design and is the Customer’s sole responsibility.
- Represent Akai™ to any third party as an autonomous agent, an automated sender, or a service that takes actions without the User’s review and click. Akai™ is a co-pilot that drafts, surfaces, and explains; the User decides and sends.
2.7 Operational and Commercial Misuse
- Resell, sublicense, or rent access to the Services, including by means of a service bureau, time-sharing, or hosted-service offering, except as expressly permitted by a written agreement with itogai.
- Use the Services to develop, train, or improve any product, service, or model that competes with the Services.
- Misuse the LatAm Region-Adjusted Pricing or any region-specific pricing benefit, including by misrepresenting the Customer’s legal-entity headquarters location.
- Share Account credentials with any individual who is not an authorized User under the Customer’s Account.
3. Reporting Abuse
If you believe that another User of the Services is violating this AUP, or that itogai is being used to send you communications you did not consent to receive, write to legal@itogai.com with as much detail as you can share, including the sender’s email address, the message in question, and any relevant timestamps. itogai will investigate in good faith and respond within a reasonable time.
If you are a recipient of a message sent through itogai by an itogai User, and you wish to be removed from that Customer’s contact records and from itogai’s enrichment cache, write to privacy@itogai.com with the email address you wish to have removed. To be clear, itogai does not send messages on a User’s behalf; every message that reaches you was composed and clicked-to-send by the User. This removal pathway exists so that recipients have a single, well-known way to break the chain regardless.
4. Enforcement
itogai may investigate suspected violations of this AUP and may, in its discretion and consistent with the Customer Terms of Service:
- issue a written warning to the Customer or the User;
- require the Customer to remediate or remove offending content or activity;
- suspend access to specific features (for example, the TrustReach™ warm-network action layer) while an investigation is pending;
- suspend the Customer’s Account, in whole or in part, with or without prior notice where suspension is necessary to protect the Services, itogai, or third parties; or
- terminate the Customer’s Account for material or repeated violations.
itogai may also report suspected unlawful activity to law-enforcement authorities and may cooperate with lawful investigations.
The remedies in this AUP are cumulative and in addition to all rights and remedies itogai has under the Customer Terms of Service or applicable law.
5. Coordinated Security Disclosure
itogai welcomes good-faith security research. If you have discovered a vulnerability in the Services, please contact legal@itogai.com with a clear technical description and reproduction steps. itogai will not pursue legal action against researchers who:
- act in good faith and avoid privacy violations, destruction of data, or interruption of service;
- give itogai reasonable time to respond before public disclosure;
- limit testing to accounts they own or for which they have explicit permission; and
- do not exploit the vulnerability beyond what is necessary to demonstrate it.
itogai does not currently operate a paid bug-bounty program but may, in its discretion, recognize substantive contributions in writing.
